Background

A bank auctioned mortgaged property after an earlier advertised sale had been postponed during the borrowers' challenge. The High Court initially allowed the borrowers to recover the property by paying the auction buyer within a fixed time. After they missed that deadline, further orders extended the opportunity and involved another purchaser.

Decision Breakdown

The Court held that the applicable recovery rules required proper thirty-day borrower and public notices, and a postponed sale required fresh notice. The bank's later sale did not comply. Nevertheless, the original High Court relief was conditional and its deadline had expired, so the later extensions were reversed. The original buyer could retain the property by paying an additional Rs. 76 lakh within four weeks; otherwise the sale would be cancelled and a fresh lawful auction held. The other purchaser was entitled to repayment with interest, and the appended December order dismissed later applications.

Lesson Learnt

Borrowers and auction purchasers both depend on compliance with statutory sale notices. A borrower must also meet a court's conditional repayment deadline; an auction defect does not excuse missing that deadline.
