Metaflex Doors India Pvt. Ltd. had filed a petition (through its authorised representative) apparently seeking the Court's intervention in an arbitration-related dispute with G Servest Consulting Private Limited. Before the matter proceeded further, the petitioner informed the Court that the underlying issue between the parties had already been resolved directly between them.
Since the dispute stood settled outside court, the petitioner's representative sought the Court's leave to withdraw the petition rather than continue litigating it. The Court had no reason to keep the matter alive once told the issue was resolved, and simply recorded the withdrawal and dismissed the petition as withdrawn: this is a one-page procedural order with no substantive ruling on arbitration law.
When commercial parties resolve their dispute on their own after going to court, they are not obligated to fight the case out: they can simply withdraw the petition, closing the matter without a ruling on the merits.
