Background

A religious society claimed compensation after a brother who served as a school headmaster died in a motor accident. Under the society's rules, members renounced their natural-family ties and their earnings and benefits belonged to the community. The tribunal awarded compensation, but the insurer later persuaded the High Court to cancel it on the ground that the society was not entitled to claim.

Decision Breakdown

The Supreme Court allowed the appeals and restored the tribunal's award. Legal representation for motor-accident claims was not confined to the narrow family categories suggested by the insurer, and the tribunal had addressed the society's relationship to the deceased. The insurer had neither supported nor pressed its standing objection at trial and could not obtain a fresh factual ruling through the later supervisory proceedings. The Court ordered compensation and interest under the tribunal's award to be deposited within eight weeks and released in accordance with that award.

Lesson Learnt

Entitlement to pursue motor-accident compensation can extend beyond an ordinary nuclear family where the claimant legally represents the deceased. An insurer cannot simply reopen an unsupported factual objection that it declined to pursue before the claims tribunal.
