Background

FIR No. 357/2024 (PS Budh Vihar) had been registered under Section 498A/406 IPC against the petitioners, who are the mother-in-law, brother-in-law and sister-in-law of the complainant (respondent no. 2). The complainant's husband (the petitioners' relative) had already passed away, and the complainant and petitioners had since compromised their disputes.

Decision Breakdown

The complainant appeared in person, was identified by the investigating officer, and told the Court in Hindi that her husband had died in 2021, that she had a son from the marriage, and that she had received a complete full-and-final settlement covering all her civil claims, including stridhan and maintenance. She confirmed she no longer wished to pursue the prosecution. Finding the settlement genuine and satisfied that continuing a full trial would serve no purpose, the Court allowed the petition and quashed the FIR and all consequent proceedings.

Lesson Learnt

Courts weigh not just whether parties have "settled" a matrimonial case on paper, but whether the complainant personally confirms it is genuine and complete, including that financial dues like stridhan and maintenance have actually been paid, before agreeing to end criminal proceedings.
