Background

The petitioner also sought a mandamus directing the Municipal Corporation of Delhi (MCD) and Delhi Jal Board (DJB) to lay trunk sewer lines and provide piped water supply in the area, and asked to be granted a provisional "Consent to Operate" suited to businesses relying on septic tanks pending such infrastructure.

Decision Breakdown

Notice was issued in the petition, and counsel for DPCC accepted notice on its behalf. DPCC's counsel clarified, on instructions, that only a show cause notice (not a final closure/compensation order) had been issued, and assured the Court that the petitioner would be given a personal hearing before any final decision was taken. Taking this statement on record, the Court disposed of the writ petition without deciding the underlying merits.

Lesson Learnt

When a regulator's counsel formally assures the Court that a business will get a fair personal hearing before any adverse action is finalized, courts will often dispose of a premature writ petition on the strength of that assurance rather than pre-judging the regulatory dispute.
