Background

The decree holder, an Australian grain exporter, sought to enforce an arbitral award dated 05.03.2021 against MMTC Ltd, the judgment debtor. Counsel informed the Court that the enforcement of that award had been stayed in an appeal under Section 37 of the Arbitration and Conciliation Act, 1996 (FAO (OS) (COMM) 210 of 2023).

Decision Breakdown

Since enforcement was stayed, the Court found no purpose in keeping the enforcement petition pending. It disposed of the petition with liberty to file it again when circumstances allow, and subject to paying stamp duty as applicable under the Indian Stamp Act, 1899 in Delhi. The Court did not decide any question about the award's merits.

Lesson Learnt

When an appellate court stays an arbitral award, enforcement must wait, and the enforcement petition can be closed with liberty to refile. Stamp duty on the relevant documents must be paid before the petition is refiled.
