Background

Two connected appeals arose out of the same transmission-tariff dispute between the Karnataka power utility and co-generator sugar mills before the Karnataka Electricity Regulatory Commission. In one matter (C.A. No. 5430/2007), the respondent's plant and machinery had already been sold in auction by the time the appeal reached the Supreme Court. In the other (C.A. No. 5429/2007), the Appellate Tribunal for Electricity had remanded certain issues back to the Commission, and the power utility challenged that remand as improper.

Decision Breakdown

For C.A. No. 5430/2007, the Court held the appeal had become infructuous since the underlying plant had already been auctioned, and disposed of it on that basis while leaving the underlying question of law open for a future case. For C.A. No. 5429/2007, the Court found no perversity in the Appellate Tribunal's order and upheld the remand to the Commission, rejecting the utility's objections to the maintainability of cross-objections, but clarified that the scope of the remand was limited to the co-generators who were actually parties before the Tribunal. Both appeals were disposed of with no order as to costs.

Lesson Learnt

A legal challenge can become moot (infructuous) once the underlying asset or dispute giving rise to it ceases to exist, and appellate courts will generally not disturb a tribunal's remand order for further fact-finding when it finds no fundamental flaw in that order's reasoning.
