Background

A factory shed in the Talkatora Industrial Estate, Lucknow had originally been allotted to a defaulting company, M/s Surya Chemicals, which later tried to transfer it to Respondent No.1 (Avadh Delicacies). After years of litigation, the shed's allotment was cancelled and re-allotted to the Appellant (Metal Seam Co.), a neighbouring unit that needed more space, but the Allahabad High Court set aside that re-allotment in 2014 on the ground that Avadh Delicacies had not been given a hearing.

Decision Breakdown

The Supreme Court held that the High Court was wrong on facts: the record showed Avadh Delicacies had in fact been given notice and an opportunity to be heard, and it had closed its own business operations years earlier with no genuine manufacturing activity to show. However, the Court also found that the Appellant itself had meanwhile been allotted two other sheds and so had no special equity to claim this particular shed either. It therefore allowed the appeal, upheld the cancellation of the original defaulting allottee's rights, set aside the fresh allotment to the Appellant too, and directed the authorities to hold a fresh public auction or invite tenders for the shed at current market value, open to any party including the original litigants.

Lesson Learnt

Government land/shed allotments challenged for want of due process must be judged on the actual record of notices issued, not assumptions; and a party's own changed circumstances (such as having already received alternative allotments) can defeat its claim to special treatment even if it otherwise had a stronger case.
