A vegetable-processing company had received financial assistance from a government-backed agri-business consortium (SFAC) and given a blank security cheque in return. Years later, SFAC filled in a date and presented the cheque, which bounced due to a signature mismatch, leading to a criminal complaint under Section 138 of the Negotiable Instruments Act for cheque dishonour.
The High Court quashed the criminal complaint after noting that, over the course of the litigation, the company had fully paid off the entire disputed cheque amount (Rs. 49.4 lakh) to SFAC. Since the purpose of the cheque-bounce law is to ensure payment rather than to punish for its own sake, and the underlying dispute no longer existed, the Court found continuing the prosecution would serve no useful purpose for either party. Quashing was made conditional on the company depositing Rs. 5 lakh in costs.
In cheque-bounce cases, fully repaying the disputed amount, even if it takes years and multiple court hearings, is generally a strong basis to get the criminal case dropped, since the law's core purpose is recovery of money owed, not punishment.
