Background

N. Jayasree (wife), her two daughters, and her mother-in-law were the dependents of N. Venugopalan Nair, who died in a motor vehicle accident in June 2011. The Motor Accident Claims Tribunal (MACT), Kottayam, awarded them compensation, but on appeal the Kerala High Court scaled down this amount. The liability of the insurer to pay compensation was not in dispute, only the quantum was contested.

Decision Breakdown

Applying the principles laid down in earlier Supreme Court rulings (National Insurance Co. v. Pranay Sethi and United India Insurance v. Satinder Kaur) on calculating future prospects, loss of dependency, loss of estate, funeral expenses, and consortium, the Court recalculated the compensation upward to a total of Rs. 85,81,815, including enhanced spousal and parental consortium amounts. It directed the insurer to deposit this amount with 7.5% interest (from the date of the claim petition) within eight weeks, and allowed the appeal with parties bearing their own costs.
