Background

A woman alleged that an armed group entered her home and her husband's office, confined family members and seized financial records to prevent recovery of a business debt. Following investigation, police filed a report against the alleged organizer and others. The High Court quashed proceedings against the organizer, treating the dispute as essentially civil and evaluating the evidence in his favour.

Decision Breakdown

The Supreme Court allowed the woman's appeal and restored the criminal proceedings against the first respondent. The allegations, witness statements and recovered documents disclosed a case requiring trial. A business-debt dispute did not eliminate the separate allegations of trespass, intimidation and forcible seizure. The High Court should not have weighed the evidence as if deciding guilt at trial. The Court ordered an expedited trial without treating its preliminary observations as findings on the merits.

Lesson Learnt

A dispute about money can also involve criminal conduct if threats, confinement or forcible entry are alleged with supporting material. Restoration of a prosecution means the allegations must be tried; it does not establish that the accused is guilty.
