Justice K. Vinod Chandran · Justice Sanjay Kumar

Background

After a fraud/collusion inquiry into inflated compensation for a small group of land owners in a 550-owner railway acquisition, the High Court cancelled the entire acquisition award for everyone, including a land owner in a different village who was never named in the inquiry or accused of anything.

Decision Breakdown

The Supreme Court held that fraud findings against specifically named individuals cannot be used to cancel every other beneficiary's compensation. Since the appellant was never implicated, his original award and arbitral enhancement were restored.

Lesson Learnt

A fraud finding against specific named people in a group acquisition cannot be applied as a blanket cancellation against everyone else in the scheme.
