Background

The respondents were engaged by North Delhi Municipal Corporation as Entomologists on a contractual basis in 1997-98 (to help counter dengue outbreaks) and continued working for years against sanctioned posts created later in 2008. The Central Administrative Tribunal directed the Corporation to consider regularizing them, and the Delhi High Court declined to interfere with that order. The Corporation then appealed to the Supreme Court.

Decision Breakdown

The Supreme Court condoned the delay, granted leave, but declined to disturb the Tribunal's direction regarding regularization itself, finding the High Court had given cogent reasons. On the question of monetary benefits, the Corporation's counsel argued it should not be saddled with back-benefits from 2008; the respondents' counsel left this to the Court's discretion. The Court modified the order so that monetary benefits would run only from 1 October 2015 (the date of the Tribunal's judgment), while still granting the respondents notional pay fixation and continuity of service.

Lesson Learnt

Even when a court upholds a worker's right to regularization, it can calibrate the financial start-date of back-benefits separately: a reminder that relief granted by one forum can be fine-tuned, not simply rubber-stamped, on appeal.
