Background

A wife filed a transfer petition asking the Supreme Court to move two related family-law cases out of courts located far from her, a maintenance case under Section 125 of the Code of Criminal Procedure pending at Barasat, West Bengal, and a related family court matter pending in Bangalore, to a single Family Court closer to her in Kolkata. The husband's counsel stated he had no objection to the transfer being granted as requested.

Decision Breakdown

Since the transfer was unopposed and a Family Court in Kolkata had jurisdiction to hear a Section 125 maintenance petition, the Court found no reason to refuse the request. The Court ordered both the maintenance case and the related family court case to be transferred to the Principal Judge, Family Court, Bankshall Court, Kolkata, and directed that both cases be heard together. Considering the young age of the parties, the Court asked the transferee judge to prioritize the cases for an expedited hearing and to consider referring the couple to mediation.

Lesson Learnt

When both spouses in a matrimonial dispute agree, the Supreme Court can consolidate and transfer related family-court proceedings to one convenient court, and such transfer petitions are usually granted quickly when unopposed.
