Background

A trial court injunction dated 29.02.2008 had restricted participation in the affairs of the Pattabiram Nadargal Iyyakiya Sangam (a society) for the period 2005-2008, and the appellants feared this injunction would continue to block them from participating in the society's elections even though that period had long since passed. Fresh elections to the society had not been held, and the Registrar of the Society (one of the respondents) was before the Court.

Decision Breakdown

The Supreme Court found the appellants' apprehension unjustified, since the trial court's injunction only ever concerned the specific 2005-2008 period, which had already ended. The Court directed the Registrar of the Society to conduct fresh elections within six months, conditional on the society's registration being renewed, and set a timeline for completing the renewal process (two months) and follow-up action (one further month) if renewal steps were taken. The appeal was disposed of accordingly with no order as to costs.

Lesson Learnt

A court order restricting a specific past period does not automatically continue to block future, unrelated activity (like a later election) once that period has lapsed: if in doubt, the proper remedy is to go back to the court for clarification/directions rather than assume the restriction still applies.
