Background

The petitioner, born in April 1982 in the unreserved category, has worked as a guest teacher with the Delhi Government's Directorate of Education since 2012. She sought a ten-year age relaxation, under a 1980 Directorate notification for women teacher candidates, for a Teacher (Primary) post in the Municipal Corporation of Delhi (MCD) advertised as No. 01/18. The Central Administrative Tribunal dismissed her original application on 18.12.2025.

Decision Breakdown

The High Court dismissed the writ petition. It held that the 1980 notification does not extend to MCD recruitment, because the MCD Recruitment Rules and advertisement contain no express provision for such a relaxation. The Court found that the Directorate of Education and MCD recruitments are distinct, and that the promotional link between the two services does not make them one service for direct recruitment. Arguments under Articles 14 and 16 failed because no similarly situated class had been treated differently under the same rules, and the existence of vacancies or later appointments did not create an eligibility right.

Lesson Learnt

Age relaxation applies only where the recruitment rules or advertisement expressly provide for it. Working in one government body does not automatically carry over its eligibility benefits to a different employer's recruitment.
