Background

A highway contract terminated in 2008 was later hit with a labour-welfare cess deduction based on a 2010 state notification applying the cess to projects "ongoing" from 2009.

Decision Breakdown

The Supreme Court held the cess law remained practically dormant until the state actually constituted the Welfare Board it was meant to fund, so it could not be validly levied on a contract that had already concluded before that machinery existed. In five connected appeals, the Court also upheld arbitral awards against NHAI, holding a "plausible" arbitral interpretation should not be second-guessed.

Lesson Learnt

A statutory levy cannot be retroactively imposed on a contract that concluded before the government put the implementing machinery in place; arbitral awards get deference unless perverse.
