Background

Builders challenged penalties imposed for digging foundations, saying the earth was reused in their construction work. The Nuclear Power Corporation also challenged a penalty for earth excavated while widening the Tarapur plant's seawater channel. Maharashtra treated the digging as unauthorized extraction of a minor mineral.

Decision Breakdown

The Court allowed the appeals because the 2000 notification treated ordinary earth as a minor mineral only when used for specified filling or levelling purposes. A penalty could not follow automatically from digging a foundation; authorities had to determine the earth's intended use. Maharashtra could reconsider the builders' cases on that basis, while the Corporation's penalties were quashed because the excavation served the purpose of its land grant and was incidental to maintaining the channel. Building permission did not itself excuse any otherwise necessary mining authorization. The constitutional challenge to the penalty provision remained open.

Lesson Learnt

A construction-related earth penalty requires examination of what the excavated soil was used for under the applicable notification. Keep records of its disposal or reuse; building permission alone does not settle mining obligations.
