Background

The appellant institution, which runs a nursing college in Gwalior, was denied recognition for its B.Sc (Nursing) course and a proposed new M.Sc (Nursing) course for the 2018-19 academic session by the Madhya Pradesh Nurses Registration Council. A Madhya Pradesh High Court order had earlier directed the Council to inspect and decide on recognition, but the institution was still not granted approval, and it appealed to the Supreme Court seeking a direction to grant recognition.

Decision Breakdown

The Supreme Court found that the institution's online application for the 2018-19 session was incomplete, missing faculty details and supporting documents, and was filed without the university's consent for affiliation, which only arrived after the application deadline. The Court also noted the institution lacked its own "Parent Hospital" of the required bed capacity, a mandatory requirement under Indian Nursing Council norms. Finding no fault in the High Court's judgment, the Supreme Court held there was no basis to grant recognition for either course for that academic year and dismissed the appeal.

Lesson Learnt

Educational institutions seeking regulatory recognition must strictly comply with application deadlines and documentation requirements: courts will not override a regulator's refusal where the institution's own paperwork was incomplete or filed late.
