Background

This order sends the case back; it does not decide the dispute. A 1987 arbitration award for about Rs. 6.63 lakh was made in a contractor's favour. A civil judge declined to enforce it, and the High Court reversed that.

Decision Breakdown

This is not a final decision on the dispute. The Court found that the High Court gave no reasons for disagreeing with the judge. It set aside the order and sent the case back to be decided afresh, if possible within three months.
