Background

Kerala authorities sought to reopen Scheduled Caste certificates issued to people described as Thandan, including an engineer whose certificate followed a final High Court decision. Longstanding confusion concerned whether certain Ezhava and Thiyya groups using that name were included. Parliament clarified the exclusion in 2007, raising questions about earlier appointments and later benefits.

Decision Breakdown

The Supreme Court dismissed the appeals against the High Court's protection of the claimants. A final judicial determination could not be reopened on the facts without established fraud, and no such fraud was shown. In this 2014 ruling, bona-fide appointments made during the earlier legal uncertainty were protected, while the 2007 amendment governed eligibility thereafter. Mahanudevan's benefits up to 30 August 2007 remained intact, but later benefits based solely on Scheduled Caste status could be withdrawn and no future claim on that basis was permitted; eligible OBC benefits remained available.

Lesson Learnt

Protection of an earlier appointment does not necessarily preserve eligibility for every future reservation benefit after the law changes. The Court separated final, bona-fide past benefits from later claims under the clarified category rules in this particular dispute.
