Background

The appellant had been in jail since 3 September 2010 and had earlier been denied a second bail application by the Rajasthan High Court. The Supreme Court had already granted him interim bail on 9 March 2017 during the pendency of his trial, and he now sought final confirmation of that release in his appeal against the High Court's refusal.

Decision Breakdown

Given the long period of incarceration and the fact that he had already been on interim bail without incident, the Court made its earlier interim bail order dated 9 March 2017 absolute, finally disposing of the criminal appeal. It clarified that any observations in the interim order about the maximum possible punishment were still subject to further verification as the case proceeded.

Lesson Learnt

Prolonged pre-trial incarceration is itself a strong ground for bail, and an interim bail order granted on that basis can be made permanent once the appeal is finally taken up, without needing to revisit the merits of the underlying charge at that stage.
