Background

Decision Breakdown

Because the applicants failed to appear and press their case despite it being called, the Court dismissed the application for want of prosecution and vacated any interim order that had been in effect.

Lesson Learnt

Filing a petition or application is not enough. You (or your lawyer) must actually appear and pursue it when the case is called. Failure to appear can result in outright dismissal for non-prosecution, regardless of the underlying merits, and any interim protection already granted is lost along with it.
