Background

The accused is charged under the NDPS Act in FIR No. 292/2024 of P.S. Bhalswa Dairy. He sought two months of interim bail, saying he needed to take part in the partition of property left by his father. The State pointed out that an earlier interim bail application on the same grounds had been withdrawn before another Bench of the Court on 07.05.2026.

Decision Breakdown

The Court held that a fresh interim bail application was not maintainable after the earlier one was withdrawn on the same grounds. The applicant's complaint that he was not taken to AIIMS for dental treatment, despite that order, could only be pursued through appropriate proceedings, not a fresh bail application. On the merits, the Court held that participation in the partition of inherited property is not a ground for interim bail where serious charges are pending. The application was dismissed.

Lesson Learnt

A repeated bail application on the same grounds, after an earlier one was withdrawn, may be rejected outright. Family or property matters generally do not justify release in a serious criminal case, and grievances about jail conditions should be raised through the proper legal route.
