Decision Breakdown

The Supreme Court held mere apprehension of reoffending after bail is not, by itself, valid grounds for preventive detention: the proper remedy if authorities distrust the bail is to seek cancellation in court, and the detention order was quashed.

Lesson Learnt

Preventive detention cannot be used simply because someone has been arrested multiple times or granted bail authorities disagree with: the remedy is to seek cancellation of bail, not bypass the judicial process.
