Background

The prosecution says that in April 2023, a group of young men attacked and stabbed Karan Parihar in a street in Anand Parbat, Delhi, after an earlier quarrel, and he later died in hospital. The applicant is an accused in FIR No. 140/2023 (IPC Sections 302, 308, 34, 147, 148, 149 and 201), and the case was pending trial at the stage of prosecution evidence. The applicant had earlier asked for his age to be determined through a bone ossification test, and the Trial Court dismissed that request in September 2024.

Decision Breakdown

The applicant pointed out that a similarly placed co-accused had already been granted bail in the same FIR. The Court reviewed the prosecution's case and the status report and, taking a cumulative view of the facts and circumstances, held that a case for regular bail was made out. Bail was granted, subject to conditions such as attending every hearing, giving the Trial Court an address, keeping a working phone number, reporting to the local police station every Monday, and not influencing witnesses.

Lesson Learnt

In serious criminal cases, the release of a similarly placed co-accused is a significant factor that courts consider when deciding a bail application. Even a bail order in a murder case comes with ongoing conditions that must be obeyed.
