Decision Breakdown

After hearing counsel, the Supreme Court held that a specific issue, whether the respondent was entitled to contest the Assembly election while being an American citizen by birth, needed to be expressly added to the issues already framed. It found the other grievances raised by the appellant were already adequately covered by the existing issues. The Court directed that this additional issue be added, and disposed of the appeals as allowed, with no order as to costs.

Lesson Learnt

Even procedural orders about how a case's legal questions are framed can be an important final step, ensuring a genuinely disputed and potentially decisive issue, like citizenship-based eligibility to contest an election, is not left out of the trial altogether.
