Background

A workmen's union (the appellant) challenged an interim order of the Bombay High Court that had stayed an earlier interim order of the Industrial Tribunal, Mumbai. The Tribunal's interim order had granted workmen a Rs. 3,000 increase in wages pending final decision on a wage reference that had been pending before it since 2013. The High Court, in a writ petition filed by the employer (respondent), had stayed that interim wage increase.

Decision Breakdown

The Supreme Court declined to interfere with the High Court's interim stay order dated 06.05.2015. Instead, noting that the underlying wage reference had already been pending before the Industrial Tribunal since 2013, the Court directed the Tribunal to decide the reference itself expeditiously, preferably before the end of the year. The Court held that the Tribunal's earlier interim order of 26.02.2015 would continue to operate only until the reference is finally decided. Counsel on both sides recorded their undertaking to cooperate in the expeditious disposal. With this direction, the Court disposed of both the civil appeal and the connected writ petition before the High Court, leaving nothing pending in either.

Lesson Learnt

Where interim relief in a long-pending labour dispute is contested, courts may decline to adjudicate the interim question on its merits and instead push for speedy final disposal of the underlying reference itself: interim skirmishes often give way to a direction for expeditious final resolution.
