Background

A partnership firm and its partners faced prosecution for failing to file income-tax returns for the relevant assessment years despite statutory deadlines and notices. They sought discharge, relying on unfinished accounts, the assessment proceedings and other objections. The Magistrate and High Court refused to end the prosecutions before trial.

Decision Breakdown

The Supreme Court dismissed the appeals and directed completion of the trial within four months. The duty to file a return was not postponed by pending assessment appeals or replaced by the department's best-judgment assessment. Statements in the partners' individual returns that the firm's accounts were unfinished did not satisfy the firm's independent filing obligation. The Court explained the limited protection provided by the proviso to Section 276CC under the law then applicable and the statutory presumption of culpable mental state under Section 278E. It upheld refusal of discharge, leaving the accused to establish their defence at trial rather than entering a final conviction in these appeals.

Lesson Learnt

A dispute about assessment or unfinished business accounts does not automatically suspend the duty to file tax returns. Separate entities have separate filing duties, and a ruling permitting prosecution to proceed should not be mistaken for the final trial outcome.
