Background

Seema, wife of an accused (himself in jail) in a 2024 murder case (FIR under Sections 302/120B/34 IPC), sought a 45-day interim bail. She needed to be present to care for her ailing mother-in-law, who was due to undergo major knee surgery on 30th September, 2026.

The Court verified through the Investigating Officer and a Status Report that the mother-in-law genuinely needed hospitalisation and surgery, and noted the applicant's husband was also in custody, leaving no one else readily available to care for her. Finding this a fit case for humanitarian interim bail, the Court granted release for a fixed period (28th September to 19th October 2026) on a personal bond of Rs. 50,000/- with strict conditions: no contact with the complainant's family, staying within Delhi, and mandatory surrender by the end date, with no further extension permitted.

Lesson Learnt

Courts can grant short, strictly time-bound interim bail purely on humanitarian/compassionate grounds (such as caring for a seriously ill family member), even while a case remains pending trial and an earlier bail plea has failed.
