Background

The appellants challenged a High Court order that had sent the question of verifying their caste status back to the Divisional Caste Certificate Verification Committee, Amaravati. Their lawyer argued the Scrutiny Committee had no power to "review" an earlier decision, so the remand was legally improper.

Decision Breakdown

The Supreme Court held that, properly read, the High Court's order had intended the Committee to examine the matter afresh, not to exercise any power of review, so there was no legal defect in the remand itself. For the sake of a clean record, it formally set aside the Committee's earlier orders of 20 January 2012 and 26 August 2013, while otherwise upholding the High Court's verification directions. It ordered that the appellants' current status quo continue until the High Court finally disposes of the matter, directed the Scrutiny Committee to complete its fresh verification within six weeks and the High Court to decide the writ petition within a further four weeks (noting the term in question was due to expire in January 2017), and disposed of the appeals and the related stay application with no order as to costs.

Lesson Learnt

A legal challenge to the fairness of a remand procedure can be fully and finally decided by an appellate court even while the underlying factual question, here, the appellants' caste status, is still left for the specialist body below to determine on a fresh, time-bound basis.
