Background

This order sends the case back; it does not decide the dispute. Shamim Bano applied for maintenance before her divorce and later separately obtained relief for mahr, belongings and the iddat period under the Muslim Women (Protection of Rights on Divorce) Act. Her continuing maintenance application was rejected. The High Court treated the separate proceedings as preventing a claim for maintenance after divorce without the parties' statutory consent.

Decision Breakdown

This is not a final decision on the dispute. The Supreme Court allowed her appeal and sent the maintenance dispute back to the Magistrate for fresh consideration and further evidence. The separate application concerning mahr and belongings did not extinguish the continuing maintenance claim under Section 125 of the Criminal Procedure Code. Applying the earlier constitutional decisions, the Court rejected restricting the claim to the period before divorce or treating the absence of an option declaration as fatal in these circumstances. It made no final decision on entitlement or the amount; any remarriage had to be considered, and she could seek interim maintenance.

Lesson Learnt

Divorce and recovery of wedding property do not by themselves end a divorced Muslim woman's maintenance claim. Eligibility and the amount still depend on evidence and the legal conditions, including remarriage.
