Decision Breakdown

This is not a final decision on the dispute. The Court held that the High Court, as first appellate court, did not properly use its powers under Section 96 read with Order XLI Rule 31 of the Civil Procedure Code, because it did not independently examine the facts and law on each contested issue. It set aside the High Court's judgment and sent the first appeal and cross-objections back to be decided afresh within six months. The Court said it had not applied its mind to the merits.

Lesson Learnt

A first appellate court must independently re-examine the facts and law on every issue raised in the appeal. There is no final ruling yet on who gets what share of the family properties.
