Background

Death-row prisoners, relatives and a public-interest organisation challenged execution after mercy petitions were rejected. They relied on events after conviction, including excessive executive delay, serious mental illness and procedural failures. The proceedings concerned whether execution remained constitutional in those circumstances, rather than a fresh trial of the original crimes.

Decision Breakdown

The Supreme Court commuted the death sentences of 15 named prisoners to life imprisonment after examining their individual circumstances. Unreasonable and unexplained executive delay could justify commutation, including in terrorism-law cases, and serious mental illness was another relevant ground. The Court also issued safeguards covering legal aid, prompt handling and written communication of mercy decisions, access to records, health evaluation, family meetings and post-mortem examination. It required at least 14 days between receipt of the mercy-rejection communication and the scheduled execution, and reiterated restrictions on premature solitary confinement. The convictions remained intact, and commutation to life imprisonment did not itself order the prisoners' release.

Lesson Learnt

People convicted of grave crimes retain constitutional protection against unlawful treatment and unfair execution procedures. Review of later delay or illness can change the punishment without reopening guilt, and families must receive meaningful notice and access to available legal remedies.
