Shikha Jain v. The State of Uttar Pradesh

Review Petition (Criminal) · 2021 INSC 739Decided 16 Nov 2021
Review Petition (Criminal) No. 395 of 2021
Justice Uday Umesh Lalit · Justice Ajay Rastogi

Background

Shikha Jain's underlying Criminal Appeal (No. 731 of 2021) against the State of Uttar Pradesh had earlier been decided by the Supreme Court in keeping with the spirit of a settlement that had been arrived at between the parties. Dissatisfied with that outcome, she filed a Review Petition asking the Court to reconsider its decision.

Decision Breakdown

The Bench examined the grounds raised in the review petition and reaffirmed that the earlier order had granted relief consistent with the settlement reached between the parties. Finding no error apparent on the face of the record, the threshold legal standard for a review to succeed, the Court dismissed the Review Petition, bringing finality to the matter.

Lesson Learnt

Once the Supreme Court disposes of a matter in line with a settlement reached by the parties, a review petition will not succeed merely because one side later has second thoughts; a review requires a genuine, self-evident error, not dissatisfaction with an outcome one had agreed to.
