Background

An applicant before the National Green Tribunal (NGT) sought protection of "Teliya Talab," a man-made lake in Mandsaur, Madhya Pradesh, alleging that construction permissions granted near the lake and untreated waste discharge were shrinking and polluting it. The NGT, relying on a "revenue trace map," ordered the local municipal body (Parishad) to stop granting construction permissions in the area, without first hearing several landowners, including a cooperative housing society whose land rights over a portion of the disputed area had already been finally decided in its favour in earlier civil litigation between the society and the State.

Decision Breakdown

The Supreme Court held that the society's appeal succeeded outright: since its title and construction rights over its land had already been conclusively decided by a civil court decree, confirmed all the way up to the High Court, the NGT could not reopen or disturb those settled rights without any review process. The Court also held that the NGT had failed to consider other relevant material affecting the other appellants, such as an approved Development Plan, a green buffer zone, and a public road, and that the map used by the NGT was found to be only a proposal, not a final map. The Court allowed all the appeals, protected the society's rights entirely, and directed the NGT to redetermine the precise boundaries of the lake afresh through a specially constituted committee of revenue, planning, municipal, and water resources officials, in pending proceedings.

Lesson Learnt

Environmental tribunals cannot override property rights and title that have already attained finality through a court decree, and any body making decisions affecting people's land must consider all relevant evidence and give affected parties a chance to be heard before restricting their rights.
