Background

Cooks and helpers at a Northern Railway training-centre mess sought permanent absorption as Railway employees. Railway officers supervised the mess, and Northern Railways bore salary expenses, but the Tribunal found that it was not a recognised canteen. The workers relied on an unsigned 1976 letter about a refundable advance to challenge that finding.

Decision Breakdown

The Supreme Court dismissed the petition and upheld refusal of regularisation. The applicable precedent required Railway Board recognition for the category of non-statutory canteen on which the workers relied. The unsigned letter, first produced during High Court review, did not establish the required sanction or its staffing and financial approvals. The Court found no reason to disturb the Tribunal's factual finding that the mess was non-recognised.

Lesson Learnt

For these workers, operating on Railway premises with Railway supervision and funding did not establish the recognised-canteen status needed for absorption. Reliable evidence of the required sanction had to be put before the fact-finding forum; an assumed approval was insufficient.
