Background

Sri Ram Builders paid money under a contract to construct a bus terminal and commercial complex on land leased to the Madhya Pradesh Road Transport Corporation. The project stalled amid disputes between public authorities, lease cancellation and the corporation's financial problems. An administrative resolution returned the land to its owner and provided a refund, but the builder sought enforcement of earlier court directions allowing development.

Decision Breakdown

The Supreme Court dismissed the appeals and left the High Court's order in place, including refund of the builder's payment with nine per cent interest. The land's thirty-year lease had expired, renewal required the owner's consent, and the builder had no direct contract with that owner. The earlier refusal of special leave without reasons did not itself convert the earlier High Court directions into a Supreme Court decision on their merits. The builder's remaining claims for breach of contract involved disputed facts and could be pursued against the transport corporation in a competent civil court, rather than enforced through these writ proceedings.

Lesson Learnt

A developer's contract with a public corporation does not automatically extend the corporation's own lease or bind the landowner. When a project fails, refund and a civil claim may be available even though a court will not order the project to proceed.
