Background

Nandeshwar Kumar obtained a teacher-training certificate in January 1995 and was appointed as a trained block teacher in Bihar in 2007. His services were later terminated because the certificate came from an unrecognised institution. A Division Bench of the Patna High Court ordered reinstatement with consequential benefits, reasoning that his qualification predated the National Council for Teacher Education (NCTE) law and that the institution's genuineness had not been properly established.

Decision Breakdown

The Supreme Court allowed Bihar's appeal and set aside the reinstatement order. It held that eligibility had to be assessed under the 2006 recruitment rules governing Kumar's 2007 appointment, rather than solely by the date of his training certificate. He lacked a certificate from an NCTE-recognised training institution as required for that appointment, so obtaining the certificate before the NCTE law took effect did not establish eligibility. The Court noted the inadequate material behind earlier findings about the college's genuineness, but resolved this appeal on the statutory qualification requirement rather than declaring the certificate fake.

Lesson Learnt

An older qualification must still satisfy the eligibility rules governing the appointment sought. Here, the certificate's early date did not secure reinstatement, and rejection of eligibility should not be confused with a conclusive finding that the certificate was forged.
