State of Bihar & Ors. v. Sanjay Kumar

Civil Appeal · Neutral citation not assigned (Civil Appeal No. 4274 of 2014)Decided 6 Jan 2016
Civil Appeal No. 4274 of 2014
Chief Justice T.S. Thakur · Justice R. Banumathi

Background

This order sends the case back; it does not decide the dispute. The question was whether a Sahityaalankar degree awarded by Deoghar Vidyapeeth is equivalent to a graduation degree under Bihar's recruitment rules for school Librarians and Teachers. The Patna High Court had ruled for the candidates and directed the State of Bihar to redo the selection process.

Decision Breakdown

This is not a final decision on the dispute. The Court said it was not commenting on the merit of the case. In the interest of justice, it sent the matter back to the Patna High Court for consideration afresh. The parties were given liberty to file additional documents and pleadings.

Lesson Learnt

There is no final ruling yet on whether the Sahityaalankar degree qualifies candidates for the Librarian post. The Patna High Court will decide the question again.
