Background

Laboratory attendants in Himachal Pradesh sought the higher salary paid to laboratory assistants, relying on earlier successful litigation by other employees. The High Court granted their claims without examining the work and qualifications of the different posts. The State argued that the earlier case involved materially different circumstances and that laboratory assistant was a promotional post.

Decision Breakdown

The Court allowed the State's appeals and set aside the orders granting higher pay. The respondents' qualifications and posts differed from those in the earlier successful civil suit, so that result could not automatically be copied. Laboratory attendants and laboratory assistants belonged to different cadres with different qualifications and duties. The High Court had not examined evidence about the actual work, conditions and other relevant factors before treating them as equal. Pay fixation ordinarily belongs to an expert body, and the employees remained free to seek relief before an appropriate forum.

Lesson Learnt

A similar job title or another employee's successful case does not automatically establish a right to higher pay. An equal-pay claim needs evidence about duties, qualifications and working conditions, particularly when the comparison is with a promotional post.
