Background

The State of Punjab filed a large batch of appeals (44 connected matters) against High Court orders. The short order itself does not re-narrate the underlying dispute in detail, but records that it arises out of the same common order that the Supreme Court had already dealt with in an earlier judgment dated 11.01.2017 in Civil Appeal Nos. 2111-2113 of 2016 (and batch), where similar impugned orders had been set aside and remitted to the High Court.

Decision Breakdown

The Court condoned the delay in filing, granted leave, and held that since these appeals arose out of the same common order already addressed in its 11.01.2017 judgment, it was unnecessary to issue notice to the respondents. It set aside the impugned orders and remitted the matters to the High Court to be taken up together with the matters already remitted there, directing the High Court to issue fresh notices to the respondents and directing the appellants to serve copies of the judgment and appeals on the respondents. The earlier 11.01.2017 judgment was made part of this judgment, and the appeals (along with any pending interlocutory applications) were disposed of on that basis.

Lesson Learnt

When a batch of appeals raises the same point the Supreme Court has already decided in an earlier ruling, the Court can finally dispose of the fresh batch simply by applying that earlier decision, even while sending the matters back to the High Court for follow-up proceedings: this is a complete, final disposal of the appeal itself, not a mere adjournment.
