Background

This order sends the case back; it does not decide the dispute. In a case of causing hurt and grievous hurt, the High Court had upheld the conviction but reduced the sentence to the time already undergone. The State of Punjab appealed against that reduction.

Decision Breakdown

This is not a final decision on the dispute. The Court discussed sentencing principles at length and set aside the High Court's order. It sent the matter back to the High Court to pass a fresh order in the revision petition in light of that law, after hearing the parties. The Court did not itself fix or restore any sentence.

Lesson Learnt

A sentencing court must weigh the gravity of the offence and the interests of society, not only the time the accused has already spent in custody. There is no final ruling yet on the correct sentence in this case.
