Background

A retired government engineer faced corruption and Penal Code charges over allegedly fabricated estimates for canal works. The department had twice refused prosecution sanction. The High Court set aside all charges, and the State appealed; the other public servant involved died during the appeal.

Decision Breakdown

The Supreme Court partly allowed the State's appeal, restoring the Prevention of Corruption Act charge against Labh Singh while leaving the Penal Code charges set aside. Under the version of Section 19 considered in this 2014 judgment, sanction was unnecessary for the corruption charge when the accused had already retired before the court took cognizance. Section 197 of the Criminal Procedure Code, however, continued to protect the relevant official acts after retirement, and the refused sanction prevented cognizance of the Penal Code charges. The Court also disapproved deliberately waiting for retirement to defeat sanction protection; the ruling permitted a charge to proceed and did not decide guilt.

Lesson Learnt

Sanction requirements can differ between offences and statutes, even for the same retired official. This decision concerns the provisions applied in 2014 and should not be treated as an automatic exemption from every sanction requirement after retirement.
