Background

This judgment answers a question of law; it does not decide the case itself. An employee resisted recovery from pension benefits of salary overpaid through mistaken pay fixation without fraud by him. Earlier Supreme Court cases had protected some recipients, while another decision permitted recovery of public money. The apparent difference led to a reference to a three-judge bench.

Decision Breakdown

This is not a final judgment in the case itself. The Court found no conflict requiring an answer to the reference and returned the matters to a Division Bench for appropriate disposal. It explained that the earlier non-recovery directions were tailored equitable relief under Article 142, whereas the later case stated the general legal position through appellate adjudication. Case-specific relief did not automatically become a binding rule for every employee. This order did not finally determine recovery in the individual petitions or set out the later categories of protected employees.

Lesson Learnt

Distinguish a court's general legal rule from exceptional relief granted on particular facts. This July reference order should not be substituted for a later merits decision bearing the same case name.
