Background

Sikkim merged three police services that had offered different promotion opportunities. It fixed inspectors' common seniority using their entry into the sub-inspector cadre and granted some officers earlier notional promotion dates. An officer who lost relative seniority successfully challenged the arrangement in the High Court, and the State appealed.

Decision Breakdown

The Supreme Court upheld the amended seniority rule and allowed the State's appeal. Using the common sub-inspector level was a reasonable way to balance the unequal advancement opportunities of the former services, rather than simply rewarding their different promotion speeds. The retrospective adjustment had a clear connection to that purpose and did not demote the challenging officer from his actual post. Although it dismissed his underlying challenge, the Court preserved the individual benefits already awarded to him, taking account of his earlier service and retirement.

Lesson Learnt

A fair merger of public services may change an employee's relative seniority and future promotion prospects. Such a change is assessed by the reasonableness of the scheme for the combined workforce, rather than by whether every individual benefits.
