Background

This was a contempt petition filed by the State of Tamil Nadu against the Chief Minister of Karnataka and others, tied to and arising out of a separate Civil Appeal (No. 2456 of 2007) pending between the same parties, in which the State of Tamil Nadu alleged non-compliance with a Court order or undertaking relevant to that appeal.

Decision Breakdown

The Bench recorded that it had already disposed of the underlying Civil Appeal No. 2456 of 2007. Since the appeal to which the contempt petition was tied had already been finally decided, the Court held there was no purpose in proceeding further with the contempt petition and closed it without further inquiry into any alleged violation.

Lesson Learnt

A contempt petition that is purely ancillary to a main case becomes infructuous once that main case itself reaches final disposal: contempt jurisdiction is tied to enforcing a live order, not to re-litigating a dispute that has already concluded.
