Background

Suman Pal, a daily-wage worker employed by the State of Uttarakhand, had earlier obtained an order for reinstatement with 50% back wages. The State challenged this before the Supreme Court, arguing reinstatement was inappropriate given he was never regularly appointed and had been relieved from service several years earlier.

Decision Breakdown

The Supreme Court held that full reinstatement with back wages would not be just in the circumstances, since the respondent was a daily wager who was never regularly appointed and had been out of service for years. The Court modified the impugned order, directing the State to instead pay a lump-sum amount of Rs. 2 lakhs within three months, after which the respondent would have no further claim. The appeal was disposed of as partly allowed.

Lesson Learnt

Courts can substitute a one-time lump-sum monetary payment for reinstatement where a worker was never regularly/permanently appointed and significant time has passed since termination: reinstatement is not automatic just because an earlier order required it.
