Background

A police officer facing charges about unexplained assets and reporting failures retired while disciplinary proceedings were pending. The High Court held that the proceedings could not continue because the charges did not involve a financial loss to the State. West Bengal challenged that interpretation of its pension rule.

Decision Breakdown

The Supreme Court allowed the State's appeal and restored the Tribunal's order permitting the proceedings to continue. Rule 10 separately authorised withholding or withdrawal of pension for grave misconduct or negligence and recovery of an actual financial loss from pension. The first power did not require proof that the government had lost money. Proceedings instituted during service could therefore continue after retirement under the rule even without an alleged pecuniary loss. The Court did not decide whether the officer was guilty; in one connected appeal it remitted unresolved merits issues to the High Court after settling the retirement question.

Lesson Learnt

Retirement does not always end disciplinary accountability where applicable pension rules preserve proceedings. Permission to continue an inquiry is separate from proving misconduct and deciding whether any pension consequence is justified.
