Background

A law student sought a CBI investigation into the death of teacher Itishree Pradhan, who was set on fire after repeatedly complaining of harassment and threats. The petition alleged failures to protect her and political influence over the investigation. Odisha had charged one accused, continued investigating an unidentified participant and dismissed several officials.

Decision Breakdown

The Court found no sufficient basis at that stage to transfer the investigation to the CBI after the State agency had filed its charge-sheet. It directed the trial to proceed promptly without waiting for the remaining investigation, and placed responsibility on the district Superintendent of Police to complete that investigation without delay. Separately, the complaints made before the attack disclosed apparent official laxity and indifference. The Court required a detailed administrative inquiry into whether other officials or authorities had failed to act, provide security or arrange transfer, followed by appropriate action on its findings. It did not determine the guilt of the accused or the liability of any individual official.

Lesson Learnt

A completed charge-sheet does not absolutely prevent transfer to an independent agency, but the court requires exceptional reasons concerning fairness or public interest. Even when a transfer is refused, failures to respond to a threatened person's complaints can require a separate accountability inquiry.
